IN RE: Realpage, Inc., Rental Software Antitrust Litigation (No. II), Case No. 3:23-md-3071 (PACER access required)
Pursuant to 28 U.S.C. § 1407, the Judicial Panel on Multidistrict Litigation (JPML) has transferred a number of actions to the Middle District of Tennessee. Individual plaintiffs, who lived in certain multifamily apartment rental housing beginning in 2016, have sued RealPage, Inc., alleging antitrust violations of Section 1 of the Sherman Act. RealPage is a software company that sells revenue management software and services to multifamily housing owners and property managers. This revenue management software recommends pricing for apartments within multifamily housing properties. Plaintiffs allege multifamily rental housing markets throughout the United States have been tainted by an illegal, horizontal price-fixing conspiracy between RealPage and the multifamily housing property owners and managers. The conspiracy is facilitated by RealPage’s revenue management software. Plaintiffs allege that horizontal competitor properties delegate their pricing decisions to RealPage. In turn, RealPage co-mingles these competitors’ commercially sensitive pricing and supply data and uses that data to price units within competitors’ properties. By co-mingling their sensitive pricing and supply data within RealPage’s revenue management software, horizontal competitors conspire to fix prices in the multifamily rental housing market.
